Georgia Worcester Results: Andrew Jackson did not support Supreme Court’s case so they were imprisoned until 1833 Order: Worcester’s conviction should be overturned Re-enforced federal government’s power by stating it was the only government who possessed the power to interfere with Indian Tribes Georgia laws were declared unconstitutional States did not have the right to rule over Indian Nations How the Problem Started Georgia passes Laws that debase Cherokee tribes’ rights- 1828 Authorized removal of Indians from land The Court:
Cherokee Nation vs. Georgia How it affected Citizens Group of missionaries were forced to get license, they refused Missionaries including Samuel Worcester were brought to Trial He appealed to Supreme Court and claimed Georgia lacked jurisdiction Cherokee’s Defense: They cited treaties
as an "independent Nation President Jackson’s response: Rejected negotiations Cherokee’s Response to Rejection: Ordered and Injuction under leadership of John Ross Sympathized with Cherokee Tribes that they their rights were being neglected….no action made though Georgia: Passed another law in 1830 that required citizens to obtain a license to live in Cherokee Nation Dismissed case, claimed it did not have the right to judge between Indian nations, only foreign nations Marshal Courts Decision:
March 3, 1832 How the Marshall Courts affected Indians:
1. Gave them Basic Property Rights
2.Analogy to a guardian (federal gov.) and its (Indian Nation)….America had ultimate power
3.Protected Indians from westward expansion Viewed them as sovereign entities who could not be governed by the states They were separate nations Marshall and the Court: Worcester v. Georgia
